Terms of Use

Welcome to My Mobile Mechanic. These Terms of Use ("Terms") govern your use of the My Mobile Mechanic mobile application ("App") operated by My Mobile Mechanic ("we," "our," or "us"). By creating an account or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years of age and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Description of Service

My Mobile Mechanic is a platform that connects vehicle owners ("Customers") with independent mobile mechanics ("Mechanics"). The App facilitates:

  • Submission of vehicle repair tickets by Customers

  • Discovery and application for repair jobs by Mechanics

  • Communication between Customers and Mechanics

  • Ratings and reviews between users

We do not perform any repair services ourselves. We are solely a platform connecting Customers with independent Mechanics.

3. User Accounts

To use the App, you must create an account with a valid email address and password. You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activities that occur under your account

  • Providing accurate and current information

  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or harmful behavior.

4. Mechanic Subscriptions

Mechanics are provided a free trial period upon registration. After the trial expires, Mechanics must subscribe to a paid plan ($19.99/month) to continue applying for jobs. Subscription details:

  • Subscriptions are billed monthly and auto-renew unless cancelled

  • On iOS devices, subscriptions are processed through Apple's In-App Purchase system and are subject to Apple's terms

  • On Android and web, subscriptions are processed through Stripe

  • You may cancel your subscription at any time through your device's subscription management settings or the App

  • No refunds are provided for partial billing periods

  • We reserve the right to change subscription pricing with advance notice

5. User Conduct

You agree not to:

  • Use the App for any unlawful purpose

  • Impersonate another person or misrepresent your qualifications

  • Post false, misleading, or fraudulent content

  • Harass, threaten, or abuse other users

  • Attempt to circumvent subscription requirements or payment systems

  • Use automated systems or bots to access the App

  • Interfere with the proper functioning of the App

  • Collect personal information of other users without consent

6. Mechanic Responsibilities

Mechanics using the App represent and warrant that they:

  • Possess the necessary skills, licenses, and insurance to perform automotive repair services in their jurisdiction

  • Will perform services in a professional and workmanlike manner

  • Will accurately represent their qualifications, availability, and pricing

  • Are solely responsible for the quality and safety of their work

  • Will comply with all applicable local, state, and federal laws and regulations

7. Customer Responsibilities

Customers using the App agree to:

  • Provide accurate information about their vehicle and repair needs

  • Communicate respectfully with Mechanics

  • Pay Mechanics directly for services rendered (payment for repair services is handled between Customer and Mechanic outside the App)

  • Provide honest and fair ratings and reviews

8. Ratings and Reviews

Users may leave ratings and reviews for other users. Reviews must be honest, fair, and based on actual interactions. We reserve the right to remove reviews that are fraudulent, abusive, or violate these Terms. Mechanics may reply to reviews left on their profile.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee:

  • The quality, safety, or legality of services provided by Mechanics

  • The accuracy of information provided by any user

  • That the App will be uninterrupted, error-free, or secure

  • The availability of Mechanics in your area

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, My Mobile Mechanic shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use the App

  • Any services performed by Mechanics found through the App

  • Any disputes between Customers and Mechanics

  • Unauthorized access to your account or data

  • Any vehicle damage, personal injury, or property damage resulting from services arranged through the App

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless My Mobile Mechanic, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Intellectual Property

The App, including its design, features, content, and branding, is owned by My Mobile Mechanic and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

13. Account Termination

You may delete your account at any time through the App's profile settings. We may suspend or terminate your account at our discretion if you violate these Terms. Upon termination:

  • Your access to the App will be revoked

  • Your profile and associated data will be deleted

  • Any active subscriptions will be cancelled (no refund for remaining period)

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
